Your Benefits Operating With Commercial Debt Collection Agencies

By Rob Sutter

It was just recently that an article describing debt collecting and the rules that accompany it was brought to my attention. I noticed it mainly because people seem so inclined to speak about the bad press and not enough conversation occurs about the actions debtors can take if they feel like their safety is being compromised. You do have rights, whether or not you are aware of them. Commercial debt collection agencies may not be morally sound across the board and that's when you can fight back.

The idea of contact is one that is strong in debt collecting and reputable agencies like Rapid Recovery mind the limits. According to the Fair Debt Collection Practices Act, it's against the law for a debtor to be contacted by commercial debt collection agencies outside of the hours between 8 AM to 9 PM. In addition, a collector cannot call someone who owes money at their place of work, especially if employers prohibit such actions. Even though these are important notes to make, phone conversation alone is not where the matter ceases.

One should also consider the concept of respect when going about the collection of specific funds. For instance, profanity being used is something that is frowned upon when collecting a certain amount. What's even worse, I believe, is the usage of threats in order to get a point across and these don't have to necessary be physical ones, either. Regardless of what the threat may entail, when such a threat comes about, it shows me that the collector has simply given up.

Not every collector is going to be reputable, which goes without saying, especially when lies are taken into account. Collectors can easily make the claim that debtors have done crimes in the past, which is an area that debtors can put their foot down on. It's a situation that's made more troubling, though, if a collector threatens the debtor with the terrifying possibility of arrest. If these people did research, though, then they'd understand that these workers do not have the slightest authority to carry such actions through.

People who are targeted by these agencies seem to think that they don't have any leeway but that isn't true. If they actually do owe money, then it's hard for them to be helped. However, if they are falsely targeted by collectors about amounts that they do not owe, then that is where the rules can come into play. A little research on the matter can go a long way and I have a good feeling that people would complain less about debts if they understood what they were entitled to better.
